Acceptable Use Policy & Terms of Service

This Acceptable Use Policy ("AUP") governs the use of services provided by The BTBIZ Community and is incorporated by reference into any agreement between The BTBIZ Community and its customers ("Customer").

Scope of Services

The term "Services" refers to all products and services ordered by the Customer using a The BTBIZ Community account or provided by The BTBIZ Community on a trial basis or free of charge. These typically include connectivity services that link The BTBIZ Community platforms to telecommunications networks over the Internet.

Prohibited Uses

Customers and their end users are strictly prohibited from using the Services in the following ways:

  • Illegal or Harmful Activities: Engaging in illegal, fraudulent, abusive, or harmful activities, or interfering with The BTBIZ Community's operations or other customers.
  • Security Violations: Attempting to bypass or disable security features, or engaging in activity that poses a security risk to The BTBIZ Community or its users.
  • Reverse Engineering: Analyzing the Services to uncover vulnerabilities or filtering methods.
  • Denial-of-Service (DoS): Launching or facilitating DoS attacks or actions that impact the availability or reliability of the Services.
  • Unwanted Communication: Repeated or mass messaging or calling that could lead to complaints.
  • Malware Transmission: Distributing viruses, worms, spyware, or other malicious content.
  • Spam or Harassment: Sending unsolicited, unwanted, or harassing messages, including calls, SMS, MMS, voicemails, or faxes.
  • Data Harvesting: Collecting personal information (e.g., phone numbers or emails) without consent.
  • Intellectual Property Infringement: Transmitting content that violates the rights of third parties.
  • Offensive Content: Sharing content that is defamatory, discriminatory, obscene, hateful, or otherwise objectionable.
  • Identity Misrepresentation: Using forged identities, caller IDs, email headers, or misleading information.

Regulatory Compliance

Users must comply with all applicable laws and regulations, including but not limited to:

  • CAN-SPAM Act
  • Telephone Consumer Protection Act (TCPA)
  • Do-Not-Call regulations
  • Data protection or privacy laws

Call Quality Standards

The following patterns may be considered abusive:

  • Excessive unanswered outbound calls
  • Low average call durations (under 12 seconds)
  • Short-duration calls that appear suspicious or automated
Important Notice: Sensitive Data

The BTBIZ Community Services are not intended for storing, transmitting, or processing sensitive data (e.g., health, financial, or government data). Customers are responsible for applying appropriate safeguards if they choose to handle such data using the Services. The BTBIZ Community assumes no liability for the handling of Sensitive Data.

Enforcement & Violations

Violating this AUP may lead to civil or criminal liability. The BTBIZ Community may, at its sole discretion:

  • Suspend or terminate the Customer's access to the Services
  • Impose applicable charges, termination fees, or penalties
  • Investigate suspected violations and cooperate with law enforcement or regulatory agencies
  • Pursue legal action to prevent violations or recover damages

Any breach of this AUP by the Customer or third parties acting on the Customer's behalf will be considered a material violation of the applicable service agreement.

Limitation of Liability

The BTBIZ Community The BTBIZ Community shall not be liable for any direct, indirect, incidental, punitive, consequential, or special damages—including but not limited to lost profits, business interruption, loss of data, or mental or emotional distress—arising out of or in connection with any actions taken under this AUP, even if The BTBIZ Community has been advised of the possibility of such damages.

Updates to this Policy

The BTBIZ Community may revise this AUP by providing written notice to the Customer at least fifteen (15) days prior to the effective date via email to the account owner. Continued use of the Services after the update effective date will be deemed acceptance of the new terms.
